Beş üniversite işbirliğinde temel hedef: Entelektüel varlıkların yönetimiyle bilgi temelli ekonomik kalkınmaya katkı

Sabancı Üniversitesi öncülüğünde, Boğaziçi, Koç, İstanbul Teknik ve Özyeğin üniversiteleri ile LES Türkiye* tarafından, ‘araştırmadan ortaya çıkan değerlerin yönetimiyle ekonomik kalkınmayı desteklemek’ amacıyla  “Araştırma Temelli Entelektüel Varlıklar (ARTEV) Yönetim Platformu” adı verilen ortak bir girişim başlatıldı. İstanbul bölgesinde 5 üniversite ve LES Türkiye’nin bir konsorsiyum çatısı altında birleşerek bilgi ve teknoloji transferi alanında başlattıkları bu çok yönlü çalışma, Türkiye’de örnek gösterilecek bir işbirliği yapısına sahip.

İstanbul Kalkınma Ajansı’nın 2010 yılı proje çağrısına bir konsorsiyum olarak katılan kurumlar, bilgi temelli ekonomik kalkınma programı çerçevesindeki ‘ARTEV Yönetim Platformu’ projesiyle 700.000 TL’ye yakın bir finansman desteği alarak bu alanda farkındalık oluşturma, kurumsal yetenek ve bilgi birikimini geliştirme, profesyonel ve mesleki sertifikasyon programı kapsamında bir müfredat alt yapısı ortaya çıkarma hedefleri ile çalışmalarına başlıyor.

ARTEV Yönetim Platformu kapsamında “İşletmelerde Araştırma Temelli Entelektüel Varlık Yönetimi” başlıklı ilk seminer, TÜSİAD işbirliği ile gerçekleştirildi.

ARTEV Yönetim Platformu kapsamında araştırma temelli entelektüel varlık yönetiminin çeşitli alanlarda uygulanması ile ilgili bir dizi seminer planlanıyor. Söz konusu dizinin“İşletmelerde Araştırma Temelli Entelektüel Varlık Yönetimi” başlıklı ilk semineri Boğaziçi Üniversitesi’nde yapıldı.

ARTEV Yönetim Platformu’nun İstanbul Kalkınma Ajansı’nın bilgi odaklı ekonomik kalkınma programı kapsamında desteklenmekte olan bir girişim olduğunu söyleyen Nihat Berker, bu girişimin en önemli özelliğinin, kurumların gayri maddi değerleri olarak tanımlanan entelektüel değerlerinin yönetimi konusuna vizyoner yaklaşımı kadar Türkiye’nin bilgi temelli ekonomiye dönüşmesi sürecine örnek oluşturacak bir işbirliği zeminine oturması olduğunu belirtti. Nihat Berker ayrıca; “Bu işbirliğimizin önemli bir bölümünü de ilgili alanlarda STK’lar ve kamu kurumları ile kurmakta olduğumuz ortaklıklar oluşturmakta, bu bağlamda İşletmelerde Entelektüel Varlık Yönetimi konulu açılış etkinliğimizi TÜSİAD ile birlikte düzenliyor olmak bizler için son derece önemli bir katma değerdir. Yanımızda yer aldıkları ve bu sıcak işbirliği için TÜSİAD Başkanı Sayın Ümit Boyner şahsında TÜSİAD’a ayrıca teşekkür etmek isterim” dedi.

‘Entelektüel Varlık’ı tanımlamak gerektiğini belirten Nihat Berker sözlerini şöyle sürdürdü: “Sabancı Üniversitesi kuruluşundan başlayarak global değişimleri yakından takip etmiş, ilgili disiplinlerde oluşan yenilikçi kavramları paydaşlarına tanıştırmak konusunda girişimci ve cesur davranmış bir kurum olarak bu platformu oluştururken de fikri mülkiyet kavramınının yerine entelektüel varlık kavramını pozisyonlandırmıştır. Bunun en temel gerekçesi fikri mülkiyet teriminin salt hukuki bir disiplin olarak algılanmasıdır. Oysa bu kavrama giren değerlerin yönetiminin orta ve uzun vadede stratejik yönetime odaklı bir işletme disiplini olarak  algılanması son derece önemlidir. Bu yönetim konusu, içerisinde teknoloji, hukuk, finans, pazarlama gibi stratejik konuları kapsayan çok disiplinli bir alandır. Entelektüel varlık en geniş tanımı ile yapısal sermaye, insan kaynağı ve ilişkisel sermaye kategorileri altında tescile tabi olan (patent, marka, tasarım, telif vb.) veya olmayan (ticari sır, veritabanları, müşteri portföyü, sözleşmeler vb.) her türlü bilgiyi içeren bir portföydür. Üretime dayalı ekonomilerde işletme değerlerinin neredeyse tamamını maddi varlıklar oluştururken, bilgi ekonomisinde ortalama şirket değerinin  yüzde 70’ini gayri maddi varlıkların yani entelektüel varlıkların değeri oluşturmaktadır.  Bu veri bizleri doğrudan bu değerlerin stratejik olarak yönetilmesinin gerektiği sonucuna götürmektedir.

Bugün fikri mülkiyet hakları korumasının önemini tartışmanın ötesine geçmiş bulunuyoruz. Bugün ekonomik olarak büyümenin kurumlarda oluşan yeni bilgi ekosisteminin stratejik olarak nasıl yönetilmesi gerektiğini ve bu kurumların küresel anlamda daha rekabetçi olarak dünya haritasında hak ettikleri yerlere nasıl gelebileceklerini konuşuyoruz. Bu varlıkların doğru stratejilerle tanımlanması, gerektiğinde korunması, değerinin saptanması, ticarete konu edilmesi, hissedarlar nezdinde görünür, ölçülebilir kılınması ve tüm bu ekosistemi destekleyen mevzuat altyapısının sağlam bir biçimde kurulması ile makro ekonomik göstergelerin daha sağlıklı oluşması, risk faktörü yüksek start-up yatırımlarının artması, katma değerli ürüne dayalı ihracatın büyümesi, yabancı yatırımın artırılması mümkün olabilecektir. Bu göstergelerden sadece bir tanesinden bir örnek vermek gerekirse patent hakları endeksinde yüzde 10’luk bir artış, ülkenin uluslararası yatırım stokunda yüzde 16’lık bir artışı beraberinde getirdiği kaydedilmiştir. Türkiye’de bu oranda elde edilebilecek bir gelişme, ilave olarak 28 milyar dolar tutarında uluslararası yatırımla sonuçlanabilir anlamına gelmektedir. Bunun yansıması GSMH’nin yüzde 1,5, ihracatın yüzde 6,5, istihdamın 28 bin ilave kişiye çıkması şeklinde olacaktır” dedi.

TÜSİAD Başkanı Ümit Boyner ise; “Bu değerli projenin hayata geçirilmesini sağlayan Sabancı, Koç, Özyeğin, Boğaziçi ve İstanbul Teknik Üniversitesi’ni ve LES Türkiye’yi tebrik ediyor, proje finansmanı sağlayan İstanbul Kalkınma Ajansı’na şirketlerin 21. yüzyılda en kıymetli değerleri olan fikri varlıklarını ülkemizde de öne çıkartabilmeleri adına sağladıkları destek için kutluyorum.” dedi. Ümit Boyner, TÜSİAD olarak, bu platformun başarılı sonuçlar üretmesi için her türlü doğrudan katılım ve katkılarını sunmak üzere ARTEV ile işbirliğine hazır olduklarını da belirtti. 21. yüzyıl koşullarında Türk iş dünyası yöneticilerinin rekabet güçlerini artırabilmeleri ve başarılı iş sonuçlarını perçinleyebilmeleri için fikri mülkiyet haklarından nasıl yararlanacaklarını bilmeleri ve yönetimine dahil olmalarının büyük önem taşıdığını vurgulayan Ümit Boyner,  buna  en iyi örnek olarak şirketinin fikri haklarını bizzat yöneten Steve Jobs’un gösterilebileceğini söyledi.

Sayılara bakıldığında, Türkiye’de son 15 yılda fikri haklar alanında büyük ilerlemeler kaydedildiğinin görüldüğünü söyleyen Ümit Boyner; “Yerli ve yabancı patent ve marka başvuruları büyük bir hızla artıyor. Kamu kaynaklarından AR-GE ve inovasyon faaliyetlerine ayrılan pay da her geçen yıl genişliyor. Fakat AR-GE yatırımlarına ilişkin teşviklerin artırılması yeterli değildir; buna paralel olarak ülkemizde fikri haklar bilincinin de gelişmesi gerekmektedir. Örneğin ülkemizde bir milyon dolarlık bir AR-GE yatırımından 0,4 tane yerleşik patent başvurusu çıkıyor. Japonya’da bu rakam 2,4, Kore’de ise 3,3” dedi. Ümit Boyner ayrıca; “TÜSİAD olarak önceliğimiz, şirketlerimizin değişen dünya düzenine en üst seviyede entegre olmaları ve rekabet edebilmeleridir. Bu doğrultuda, YOİKK Fikri ve Sınai Mülkiyet Hakları Teknik Komitesi Eylem Planı kapsamında şirket ve kurumların fikri hakları şirket stratejisine entegre etmesi, fikri haklarını yönetmesi ve ticari hayatta aktif kullanmasına yönelik öneriler geliştirmek amacıyla bir çalışma raporu hazırlamaktayız. Bu rapor ile yatırım ortamının iyileştirilmesi, Türk ekonomisinin güçlendirilmesi ve Türkiye’nin rekabetçiliğinin artırılması için sınai mülkiyet hakları alanındaki mevcut teşvik sistemlerini gözden geçiriyor ve yeni teşvik sistemlerini öneriyoruz. Önerilerimiz, şirketlere sınai mülkiyet hakları personeli istihdamı ve sınai mülkiyet haklarına ilişkin alt yapı kurulması konusunda teşvik verilmesini ve sınai mülkiyet haklarının ticarileştirilmesi sonucunda elde edilen gelirler üzerindeki vergilerin kaldırılmasını içermektedir. Söz konusu önerilerin hayata geçirilmesinin fikri hakların işletmelerde kullanılmasının ve ticarileştirilmesinin özendirilmesi açısından son derece yararlı olacağına inanıyoruz” dedi.
